Signature Co-Hosting Terms & Conditions

This section outlines the terms and conditions under which Signature Service will provide co-hosting services to the Host for the short term rental of the Property listed on Airbnb or similar vacation rental platforms. The goal is to create a mutually beneficial relationship where Signature Service manages operational, customer service, and/or maintenance aspects of the Property.
1. Co-Host Responsibilities
Signature Service shall perform the following duties as part of its co-hosting role:
Listing Management:

Create and maintain the Property listing on Airbnb or similar platforms, including setting pricing, calendars, and availability.
Guest Communication:
-
Handle all inquiries, booking confirmations, and guest communications throughout the booking process and during the stay.
CheckIn/CheckOut:
-
Coordinate guest checkin/checkout procedures, including key handover, welcome instructions, and property tours as necessary.
Property Maintenance & Housekeeping:
-
Ensure regular maintenance, cleaning, and stocking of supplies.
Guest Reviews:
-
Manage and respond to guest reviews in a timely manner.
2. Host Responsibilities
The Host agrees to provide the following:
Timely Access to the Property:

The Host shall ensure that Signature Service has timely access to the Property as needed to facilitate checkins/outs, maintenance, cleaning, and any other co-hosting duties.
Property Conditions:

The Host is responsible for maintaining the Property in a safe, clean, and habitable condition and ensuring all appliances and amenities are in working order.
Compliance with Laws:
-
The Host must comply with all local, state, and federal laws, including rental regulations, licensing requirements, and tax obligations.
Insurance:
-
The Host shall carry appropriate insurance coverage for the Property, including homeowner’s insurance and liability insurance, to protect against property damage and injury claims.
3. Financial Terms
CoHost Compensation:

Signature Service will receive a co-hosting fee, calculated as a percentage of the nightly rental revenue, as agreed upon in writing. This fee will be paid on a [weekly/monthly] basis and is deducted from the Host’s Airbnb payout.
Refund Policy for Deposits:

Security Deposit: A security deposit (if applicable) may be held for each guest booking and refunded within 14 days of the guest's departure, provided there are no claims for damages or additional fees incurred during the stay.

Refund of Host Payments: In the event of a guest cancellation, Signature Service will manage refunds according to Airbnb’s cancellation policy. Refunds for cancellations made by the Host (not guestrelated) will be addressed on a casebycase basis and agreed upon in writing.
Damage/Loss Liability:

Host Responsibility: The Host shall be responsible for any damage, theft, or loss that occurs to the Property as a result of negligence or failure to maintain the Property adequately.

CoHost Liability: Signature Service is not liable for any damage, loss, or theft unless it is caused by the direct negligence or actions of Signature Service. If damage is caused by a guest, Signature Service will assist the Host in pursuing the claim through Airbnb’s resolution center, but responsibility for the damage ultimately lies with the Host.

Guest Damages: Guests are required to report any damages to Signature Service during or immediately after their stay. If damages are reported and substantiated, Signature Service will initiate a claim against the guest (if applicable) or process it through Airbnb’s resolution center.
Release of Liability for Illegal Activities

Signature Service shall not be held liable for any illegal activities, items, or persons discovered during the management of any booking at the Property. The Host acknowledges and agrees that Signature Service and its staff are not responsible for detecting or preventing illegal activities on the Property unless such activities come to light during the performance of their co-hosting duties.

In the event that Signature Service or its staff becomes aware of any:
- Illegal items (e.g., drugs, weapons, stolen property);
- Illegal activities (e.g., illegal gambling, human trafficking, unlawful business operations);
- Persons engaged in illegal or suspicious behavior (e.g., individuals with outstanding warrants or engaging in criminal conduct);
Signature Service shall take the following actions:
Immediate Reporting:

Signature Service will report any such findings immediately to the Host, the applicable booking platform (e.g., Airbnb), and, where necessary, the appropriate local law enforcement authorities.
No Liability for Discovery:

Signature Service shall not be held liable for any consequences resulting from the discovery or reporting of illegal activities, persons, or items. This includes but is not limited to potential legal issues, damage to the Property, or any negative impact on the Host’s reputation.
Cooperation with Authorities:

Signature Service agrees to cooperate fully with law enforcement and other relevant authorities as necessary in investigating and resolving any legal concerns arising from the discovered activities, items, or persons.
Host's Responsibility:

The Host acknowledges that they are solely responsible for ensuring the Property is not used for illegal activities and for complying with all applicable laws and regulations. The Host is also responsible for taking appropriate action to remove guests or individuals involved in illegal activities from the Property.
Timely Access to Property

CoHost Access: Signature Service will need access to the Property for cleaning, maintenance, and guest services. The Host agrees to provide Signature Service with necessary keys, entry codes, or access permissions. Signature Service must have access to the Property within a reasonable timeframe to handle checkin/checkout, as well as urgent maintenance or cleaning issues.

Emergency Access: In the event of an emergency (e.g., plumbing issues, electrical malfunctions, etc.), Signature Service shall have the right to enter the Property without prior notice to ensure the safety and wellbeing of guests, and address the emergency as soon as reasonably possible.
4. Cancellation Policy
Host Cancellations:

The Host must provide Signature Service with at least [insert number of days, e.g., 7 days] notice for any changes or cancellations to the booking or co-hosting services. Any cancellations made without adequate notice will result in a [insert %] cancellation fee, to be paid by the Host.
Guest Cancellations:

Signature Service will adhere to Airbnb’s published cancellation policies, which will be communicated to guests at the time of booking.
5. Dispute Resolution
Negotiation and Mediation:

In the event of a dispute between the Host and Signature Service, both parties agree to first attempt to resolve the matter through good faith negotiation. If a resolution cannot be reached, the parties agree to mediate the dispute before seeking legal remedies.
Florida Law: This Agreement shall be governed by and construed in accordance with the laws of the State of Florida.
6. Termination of Agreement
Termination by Host:

The Host may terminate this Agreement at any time by providing [insert number of days, e.g., 30 days] written notice to Signature Service. The Host will be responsible for any co-hosting fees incurred up to the termination date.
Termination by CoHost:

Signature Service may terminate this Agreement with 15 Days notice if it determines, at its sole discretion, that it can no longer provide services due to performance issues, property condition, or failure to comply with this Agreement.

7. Miscellaneous
Indemnification:

The Host agrees to indemnify and hold Signature Service harmless from any claims, damages, or losses that arise from the Host’s failure to meet the terms of this Agreement, including property maintenance and legal obligations unless expressly specified in a document signed by both the Host & Co-host.
Confidentiality:

Both parties agree to keep all terms and any sensitive information related to this Agreement confidential, unless required by law or court order.
Force Majeure:
-
Neither party will be held liable for any failure or delay in performance due to events beyond their control, such as natural disasters, pandemics, government regulations, or other acts of God.
